Under the guidance of Sheikh Mohammed bin Rashid Al Maktoum, the visionary Vice-President and Prime Minister of the UAE and Ruler of Dubai, the establishment of this department aligns with his progressive vision for the emirate. Judge Mohammed Jassim Al-Shamsi, the head of The Special Court of Inheritance in Dubai, emphasized that this decision reflects the leadership’s commitment to creating an inclusive and accommodating environment for all residents.

This new department operates in accordance with Law No. 15 of 2017, issued by Sheikh Mohammed, which governs non-Muslim wills and inheritance matters in Dubai, including the Dubai International Financial Centre. The law provides a transparent legal framework that empowers non-Muslims to draft their wills and manage their inheritance affairs within a regulated system.

By encouraging non-Muslim expats to register their wills and manage their assets in Dubai, the law addresses various legal concerns associated with inheritance cases and offers suitable solutions. This move not only enhances the overall efficiency of the process but also instills confidence among non-Muslim residents regarding the protection and distribution of their assets.

The establishment of this dedicated department underscores Dubai’s commitment to fostering a diverse and inclusive society. It provides non-Muslim expatriates with a dedicated platform through Dubai Courts to prepare, manage, and enforce their wills, ensuring that their wishes are respected and implemented according to their personal laws.

This progressive step by Dubai Courts showcases the emirate’s dedication to facilitating legal processes and empowering individuals, irrespective of their cultural or religious backgrounds. The special department for non-Muslim expats’ inheritance matters sets a precedent for other jurisdictions, illustrating Dubai’s commitment to providing a secure and transparent legal environment for all residents.
