The Lahore High Court (LHC) bars PHA from using city parks for commercial purposes. Justice Shahid Karim issued the order while hearing petitions on smog, environmental degradation, and water issues.
The court emphasized that parks should remain public spaces and no commercial activity may take place without prior approval from the Environmental Commission. This ruling bars PHA from renting parks for businesses such as restaurants or floating cafes.
Justice Karim directed that two Lahore parks be restored to their original condition and developed as model parks. The judge highlighted the need for proper management, saying, โThe PHAโs primary responsibility is park maintenance, not commercial exploitation.โ
The court also observed that industrial units are major contributors to pollution. Justice Karim suggested creating a dedicated regulatory unit for industries, stating, โThere should be a proper, separate unit for industries to control pollution.โ
During the hearing, petitioner lawyers raised concerns over a restaurant established at Dungi Ground and a floating restaurant under construction near Jallo Park. The court reiterated that past directives had barred PHA from such projects and recommended establishing libraries and community spaces instead.
This latest ruling bars PHA from further commercial ventures until proper judicial or environmental approval is obtained. The LHC also asked the PHA to present any judicial precedent supporting their activities in parks.
The court adjourned the hearing until January 23, while clearly indicating that the focus must remain on environmental protection and public access. With this decision, the LHC reinforces the principle that city parks are meant for the community, not profit-driven commercial activities.
