Najaf Hameed, brother of former DG ISI Faiz Hameed, has filed a petition in the Islamabad High Court (IHC) challenging the bail cancellation issued against him.
The Special Central Court had cancelled his bail on January 26, following a request by the Federal Investigation Agency (FIA) in a fraud case. Najaf Hameed was not present in court, so he was not arrested at the time.
In his petition, Najaf Hameed called the bail cancellation โillegal and without lawful authority.โ He argued that the order was issued mechanically, causing a gross miscarriage of justice.
He also claimed that the FIA is prosecuting him maliciously, based on baseless and concocted allegations. Najaf stated that the case was filed with mala fide intent and ulterior motives.
Najaf Hameed asked the IHC to set aside the bail cancellation and restore his pre-arrest bail. He requested that the FIA be restrained from arresting him until the court disposes of his petition.
The petition names the State and FIA as respondents. According to the earlier court order, Najaf Hameed, a former Halqa Patwari of Mouza Pind Parian, Islamabad, allegedly issued fake land registry documents in 2009 and 2010. These actions reportedly caused a loss to the lawful rights of the real landowner.
The court also noted that as a public servant, Najaf Hameed allegedly misused his official position by entering fraudulent land mutations using records in his custody, apparently for personal gain.
Legal experts say the IHC will now review whether the bail cancellation was justified and if proper legal procedures were followed. The case has attracted attention due to Najaf Hameedโs family connections and the nature of the fraud allegations.
Until the petition is decided, Najaf Hameed remains out of custody. The courtโs decision will determine whether his pre-arrest bail can be restored or if he will face immediate arrest in the ongoing fraud case.
