Former DG FIA Files LHC Petition To Recover Wife From His SSP Son

Former DG FIA Mian Muhammad Amin has filed a petition in the Lahore High Court, seeking recovery of his wife from his son’s custody. The case highlights a family dispute over the care and residence of the elderly woman.

Court bailiff Tanveer Hussain produced the elderly lady in the courtroom on a wheelchair following the court’s order. The bench questioned why the son was keeping his mother against her wishes, noting that the elderly couple wants to live together.

SSP Afnan Munib, the son, told the court that his mother is seriously ill and receiving proper care at his residence. He emphasized that two servants attend to her round the clock and that a doctor visits the house for treatment.

Chief Justice Aalia Neelum stressed that every citizen has the right to live according to their choice. She said, “It is her fundamental right. How could you keep her forcefully?” The bench also inquired about alleged misconduct by the son toward the court’s bailiff, but the SSP denied any misbehavior.

The petitioner, Mian Amin, stated that his son, posted as SSP in the Special Branch, had expelled him from the family home and was keeping his wife with him. He submitted that he seeks recovery of his wife so that the elderly couple can live together peacefully.

During the hearing, the court asked for the woman’s current condition and medical treatment. SSP Afnan Munib explained that she could not enter the courtroom due to her illness and that all necessary arrangements were being made at home for her care.

The court observed the elderly woman in the courtroom on a wheelchair and considered the petitioner’s request. The bench highlighted that her fundamental rights should be respected and that no citizen should be kept against their will.

Mian Muhammad Amin’s petition formally seeks recovery of his wife from his son, aiming to reunite the couple and ensure proper care and living arrangements. The case is ongoing, with the court expected to make further orders on her custody and welfare.

This matter underscores the legal recognition of personal rights, especially for elderly citizens, and demonstrates the court’s role in resolving family disputes where fundamental rights are at stake.
