Lease Cancellation of One Constitution Avenue Is Declared Legal by Islamabad High Court

The Islamabad High Court has upheld the cancellation of the lease for the One Constitution Avenue project. The court dismissed a petition filed by BNP (Private) Limited, challenging the decision of the Capital Development Authority (CDA).

In its ruling, the court declared that the cancellation of the Constitution Avenue lease was lawful. It stated that the decision was made in line with earlier directions issued by the Supreme Court. The judgment was announced in open court by the Chief Justice.

According to the court, the petitioner failed to meet key financial obligations. It highlighted that a payment of Rs 2.916 billion, due in 2022, was not made. The court also noted that the company did not follow the terms of a court-approved revival plan.

The judges observed that this failure amounted to a serious breach of obligations. They said the petitioner’s arguments regarding notice periods were weak. The claims were described as unsubstantiated and not strong enough to challenge the cancellation.

The case was linked to the high-profile One Constitution Avenue project in Islamabad. The development has remained under legal scrutiny for several years. Authorities have been closely monitoring compliance with financial and legal requirements.

The court also dismissed an execution petition filed in the matter. In addition, applications submitted by third-party investors were disposed of. The court advised these investors to approach relevant forums for their concerns.

Officials from the Capital Development Authority welcomed the decision. They said the ruling supports enforcement of rules and agreements. It also highlights the importance of fulfilling contractual obligations.

Legal experts believe the judgment sets a clear precedent. It reinforces that financial commitments must be met in large-scale development projects. Failure to comply can result in strict action, including lease cancellation.

The ruling is expected to have an impact on future developments along Constitution Avenue. It signals that authorities will take firm action in case of non-compliance.
