Court Orders TMC Orangi Town To Pay Rs15 Million Compensation

A local court has issued a major ruling in a negligence case involving a fatal incident in Karachi. The Court orders the Town Municipal Corporation (TMC) Orangi Town to pay Rs15 million in compensation to the legal heirs of the deceased.

The case was heard by the Senior Civil Judge West. The judge held TMC Orangi Town responsible for the accident. However, the court cleared the Karachi Metropolitan Corporation (KMC) from liability.

The victimโ€™s family had filed a compensation petition under the Fatal Accidents Act, 1855. The case was submitted through Advocate Usman Farooq against both civic bodies.

According to the details presented in court, the deceased named Arif died during heavy rainfall on July 26, 2020. He was returning home when he fell into an uncovered nullah.

The petition stated that poor maintenance and lack of safety measures caused the accident. The victim suffered severe injuries and died on the spot.

During the hearing, Court orders highlighted that the deceased was young, healthy, and unmarried. The judge noted that his life was lost due to civic negligence.

The ruling stated that TMC Orangi Town failed to take proper preventive steps. These included covering open nullahs and ensuring public safety during heavy rains.

The court observed that the negligence directly caused the fatal incident. It described the conduct of the municipal body as careless and irresponsible.

In its defense, TMC Orangi Town denied the allegations. Officials argued that safety arrangements had been made during the monsoon period.

However, after reviewing arguments and evidence from both sides, the court rejected the defense. The Court orders clearly stated that liability rested with TMC Orangi Town.

The judge directed the civic body to compensate the family with over Rs15 million. The decision aims to provide financial relief to the legal heirs of the victim.

The case has once again raised concerns about urban safety and infrastructure management. Citizens continue to demand stronger preventive measures during rainy seasons.
