ISLAMABAD – The Islamabad High Court has restrained authorities from taking unlawful action against legal Sheesha Cafes and restaurants operating within the law.
The court, however, made it clear that illegal operators will not receive similar protection. Businesses violating legal requirements or permit conditions can face enforcement action.
The Islamabad Police has been directed to continue its crackdown against illegal sheesha establishments. The order also covers businesses found breaching the conditions attached to their permits.
The ruling comes amid concerns over the lack of a clear regulatory framework for Sheesha Cafes in Islamabad. The court questioned the absence of proper rules governing their operations.
The federal government has been asked to address the regulatory gap. Authorities have been given one month to finalize and implement rules for sheesha establishments.
The federal cabinet has also been directed to approve relevant legislation concerning restrictions on sheesha smoking. The court asked the process to be completed at the earliest.
The Advocate General Islamabad and Additional Attorney General were directed to coordinate with relevant authorities. They must ensure progress on the required legislation and regulatory framework.
During the hearing, the court highlighted the government’s responsibility to protect young people. It expressed concern over drugs and sheesha smoking among the younger generation.
The bench observed that the lack of proper regulations has created uncertainty. It also stressed the need for clear legal standards for businesses in this sector.
Authorities have been ordered to complete the regulatory process within one month. They must also submit a compliance report to the court.
The Anti-Narcotics Force has been directed to assist Islamabad Police. The agencies will work together against drug-related activities linked to illegal establishments.
The court also ordered that all petitions concerning the matter be clubbed together. This move will allow the legal questions surrounding Sheesha Cafes to be considered collectively.
The hearing has been adjourned until October 13. Until then, lawful businesses can continue operating without unlawful or coercive action.
However, establishments operating without required permissions remain subject to enforcement. The order therefore provides relief to compliant businesses while maintaining pressure on illegal operators.
