The Islamabad High Court (IHC) has issued notices to the federal government, requesting a detailed report on measures taken for social media regulation for children under 16.
Justice Arbab Muhammad Tahir issued the order after hearing a petition filed by minor Akbar Khan Shinwari through his father. The petition demanded enforcement of fundamental rights and protection of minors from online harm.
The court emphasized that childrenโs safety and well-being online are paramount. It noted that unregulated access to social media exposes minors to cyberbullying, mental health risks, privacy violations, and harmful content.
The IHC directed the federal government, Ministry of Information Technology, Pakistan Telecommunication Authority (PTA), and Pakistan Electronic Media Regulatory Authority (PEMRA) to submit a report by March 3. The report must include para-wise comments on steps taken toward a regulatory framework for childrenโs access to social media.
Authorities were asked to provide details on age-verification mechanisms and how social media platforms enforce compliance with age restrictions. The court also sought progress on the establishment of the proposed Social Media Protection and Regulatory Authority.
The IHC requested information on any draft policies or executive orders under consideration for social media regulation. The report must explain monitoring strategies, enforcement measures, and compliance with the Prevention of Electronic Crimes (Amendment) Act (PECA), 2025.
The petitioner argued that several countries have enacted laws to regulate minorsโ social media usage. He urged Pakistan to implement similar protections to safeguard children from online harm.
The IHC stressed the need for comprehensive rules to regulate access, monitor content, and protect minorsโ rights online. Officials must clarify steps taken to ensure effective enforcement while balancing digital freedom and child safety.
This case highlights growing concerns about online safety for children and the governmentโs role in ensuring responsible social media regulation in Pakistan.
