The Lahore High Court has granted post-arrest bail to Muhammad Abbas in an immigration-related case.
Justice Muhammad Amjad Pervaiz announced the decision while hearing Abbas’s bail petition. The court ordered his release against a bail bond of Rs200,000.
The judgment examined whether an amended law could apply to an alleged offence committed before the legal change.
Justice Pervaiz referred to Article 12 of the Constitution. He said the provision protects accused persons from harsher punishment for past offences.
The judge observed that the amended law could not be applied retrospectively. He said the 2025 amendment to the Immigration Ordinance would not apply to Abbas.
According to the ruling, the alleged offence occurred before the amendment was introduced. Therefore, the accused could not face a more stringent provision under the amended law.
The court also rejected the idea of keeping Abbas in custody merely as punishment. Justice Pervaiz said imprisonment before trial should not become a form of punishment.
The judgment also highlighted shortcomings in the prosecution’s case. The court noted that important details were missing from the First Information Report.
The FIR did not mention the date, time or location of the alleged payment. The court considered this omission relevant while examining the bail request.
The judge also noted that no objectionable material had been recovered from Abbas. He said further investigation was necessary to establish the allegations against him.
The ruling therefore accepted the post-arrest bail petition. Abbas was ordered to be released after submitting the required bail bond.
The court’s decision also emphasized the importance of constitutional protection. Article 12 prevents retrospective application of harsher criminal punishment.
The amended law was central to the court’s reasoning. Justice Pervaiz found that the 2025 changes could not be used against Abbas for an earlier alleged offence.
The decision does not amount to an acquittal. The case will continue through the normal trial process.
The prosecution will still have an opportunity to establish its allegations against the accused. Further investigation may provide additional evidence during the proceedings.
The court also left room for future action by the prosecution. It said a petition could be filed to cancel Abbas’s bail.
Such a petition could be considered if there is an unreasonable delay in starting the trial. The observation gives the prosecution a possible legal remedy.
The ruling reinforces the principle that criminal laws cannot normally impose harsher consequences for past conduct.
The amended law may apply to offences committed after its introduction. However, the court found it unsuitable for the alleged offence in Abbas’s case.
