The Sindh High Court has dismissed a petition by the leading tractor manufacturer, Al Ghazi Tractors Limited, challenging the requirements of certain documents under S.R.O 563 (I)/ 2022 by the Large Taxpayer Office (LTO) Karachi for processing its sales tax refund claims.

The court dismissed the petition on the point of maintainability, citing a recent Supreme Court judgment in the case of Digicom, which disapproved of directly approaching the court by short-circuiting the legal process provided under the law. The SHC emphasized that the petitioner had filed the petition prematurely, as the factual determination regarding the admissibility of refund claims needed to be made by the concerned department.

The court suggested that the petitioner could respond to the impugned letter by raising legal objections, and the concerned department would proceed further by law.
