Imran Khan Remains in Attock Jail Despite Contrary Orders

Despite instructions from the Islamabad High Court, PTI Chairman Imran Khan was not relocated to Rawalpindi’s Adiala Jail until late on Monday. This delay was primarily attributed to two factors: security concerns and the absence of a formal written order.

However, one of his lawyers asserted that the former prime minister had, in fact, been moved to Adiala Jail, causing confusion on social media platforms.

During the hearings for petitions requesting Mr. Khan’s transfer to Rawalpindi, IHC Chief Justice Aamer Farooq remarked that under-trial prisoners (UTPs) from all federal capital courts were typically housed at Adiala, and he issued instructions to transfer Mr. Khan to that facility.

The decision was made following arguments put forth by Mr. Khan’s attorney, Sher Afzal Khan Marwat, who pointed out that the court had suspended Mr. Khan’s sentence in the Toshakhana case, and he was currently facing a trial in the cipher case before a special court in Islamabad. Mr. Khan, being an under-trial prisoner from the federal territory, was argued to be appropriately placed in Adiala Jail.

Justice Farooq noted that Mr. Khan’s status had changed as a result of the suspension of his sentence.

Addressing AAG Barrister MunΒ­aΒ­war Iqbal Duggal, Justice Farooq inquired about the status of other under-trial prisoners (UTPs).

Mr. Duggal responded that all UTPs from Islamabad’s courts were typically held in Adiala Jail. Consequently, Justice Farooq ordered Mr. Khan’s transfer to Adiala Jail and instructed the jail administration to provide him with all entitled facilities.

However, as of the time this information was being reported, Mr. Khan had not been relocated to Adiala Jail because Justice Farooq had not issued a written order, owing to his prior commitments at the Federal Judicial Academy.

Subsequently, Mr. Khan’s legal team, citing authoritative sources, asserted that the court’s instructions had been executed. Barrister Naeem Panjhota, a prominent member of Mr. Khan’s legal team, claimed that Mr. Khan had indeed been transferred to Adiala Jail.

Nevertheless, the administration of Attock Jail disputed this claim, stating that Mr. Khan had not been moved due to security concerns and that they were still holding him.

In a message on [date], Mr. Panjhota expressed his confusion, as he had been informed that Imran Khan had been relocated to Adiala Jail, but he found it perplexing that Attock Jail authorities were also asserting their custody of the PTI chairman.
