Dutch Court Orders Meta To Provide Algorithm-Free Timelines

A Dutch court has ruled that Meta must provide users with algorithm-free options on Facebook and Instagram. The decision comes after concerns that algorithmic feeds violate the EU’s Digital Services Act (DSA).

The court stated that Dutch users lack the freedom to make β€œfree and autonomous choices” due to Meta’s recommendation systems. Instead of continually pushing content through algorithmic feeds, Meta must offer alternatives such as chronological timelines or other algorithm-free displays.

The case was filed by Bits of Freedom, a Dutch digital rights organization that opposes algorithm-driven content dominance. Maartje Knaap, spokesperson for the group, said, β€œIt is unacceptable that a few American tech billionaires can determine how we view the world.”

Meta plans to appeal the ruling, arguing that issues related to the DSA should be addressed by EU regulators and the European Commission, not national courts. A Meta spokesperson stated that such national proceedings could threaten the digital single market and EU-wide regulatory consistency.

If Meta fails to comply, it could face fines of €110,000 ($117,450) per day, up to a maximum of €5.5 million ($5.8 million).

The Digital Services Act, effective since 2022, holds large tech firms accountable for harmful content, privacy protection, and user control. It has already led to significant changes at major platforms, with fines imposed on Apple, Alphabet, and Meta for violations.

For Dutch users, the court’s decision means Facebook and Instagram will soon provide algorithm-free options, giving users more control over what they see. Advocates say this will reduce distortions in news and information consumption caused by algorithmic feeds.

The ruling highlights the growing European scrutiny of Silicon Valley tech giants and reinforces the push for transparency, accountability, and user autonomy in online platforms. Meta must now ensure algorithm-free choices are accessible while complying with DSA regulations.
