The Acting Governor signs the โConstitutional Benches of Sindh High Court Procedure and Practice Ordinance 2025,โ bringing it into immediate effect.
Under the ordinance, constitutional courts will now be established across Sindh. Judges for these courts will be appointed following the summary approved by the provincial law department, which was recently forwarded to the Acting Governor.
This move comes amid ongoing legal challenges. Last Thursday, the 27th constitutional amendment, which facilitates the appointment process for judges in constitutional courts, was contested in the Sindh High Court.
โThe constitutional amendment clashes with the fundamental structure of the constitution,โ stated Ibrahim Saifuddin, an advocate who filed the petition. He added that the amendment undermines the division of powers, judicial independence, and the rule of law.
The petitioner requested the court to declare the 27th constitutional amendment unconstitutional, contrary to Islamic and democratic principles, and therefore null and void. The petition highlights concerns that the amendment enhances the role of the parliament and executive in appointing judges to both the constitutional court and the Supreme Court.
Following the approval, the Governor signs the ordinance, signaling the governmentโs intent to implement constitutional courts as part of its judicial reforms. Officials said this measure is intended to streamline judicial procedures and strengthen the legal system in Sindh.
Legal experts expect further scrutiny in the Sindh High Court, where the petition challenging the 27th amendment will be heard. The courtโs decision could influence the implementation of the new ordinance.
By signing the ordinance, the Governor signs off on a significant step in Sindhโs judicial framework, ensuring the establishment of constitutional benches and formalizing the appointment process for judges in these courts.
The ordinance is now in effect, and the provincial authorities have begun preparations to operationalize the constitutional courts in selected jurisdictions across Sindh.
