PTI Founder And Bushra Bibi To Appeal Toshakhana-2 Conviction

Pakistan Tehreek-e-Insaf (PTI) chief Imran Khan and his wife, Bushra Bibi, have decided to appeal their convictions in the Toshakhana-2 case. Sources confirmed that both will file separate criminal appeals in the Islamabad High Court (IHC) on Monday. The appeals will be submitted through their lawyer, Barrister Salman Safdar, seeking to overturn the special court’s recent verdict.

The defence argues that the prosecution failed to prove its case. The petitions state that an individual cannot be punished multiple times for the same offence and claim the Special Judge (Central) lacked proper jurisdiction in the Toshakhana-2 case.

The appeals further allege that Imran Khanโ€™s removal from office was part of a โ€œwell-orchestrated political conspiracy,โ€ resulting in unprecedented political victimisation for both him and Bushra Bibi. The defence accuses the National Accountability Bureau (NAB) and the Federal Investigation Agency (FIA) of acting with mala fide intent and allowing their investigative powers to be misused by political opponents.

According to the petitions, the Toshakhana Policy, 2018, was fully followed. All gifts received by Imran Khan and Bushra Bibi were declared and deposited with the Cabinet Divisionโ€™s Toshakhana. The required payment of 50 percent of the value exceeding the exemption limit of Rs30,000 was made, ensuring lawful retention.

The defence also criticises the prosecutionโ€™s handling of the case. They argue that Sohail Abbasi, a key participant, was made an approver without being arrested or processed according to legal safeguards. Similarly, prosecution witness Syed Inamullah Shah allegedly facilitated undervaluation but was examined as a witness rather than named as an accused.

The petitions describe these actions as selective and discriminatory, highlighting political bias in the Toshakhana-2 case.

The Toshakhana-2 case drew widespread attention last week when a special court sentenced Imran Khan and Bushra Bibi to 17 years in prison. Their appeals now seek to overturn the conviction and challenge the legal proceedings surrounding the high-profile case.

This marks the latest development in the ongoing legal battle over Toshakhana-2, which remains a focal point of political and judicial discourse in Pakistan.
