Justice Tariq Jahangiri Alleges IHC Chief Justice Dogar Pressured Him To Resign

Islamabad High Court (IHC) Judge Justice Tariq Jahangiri has formally accused IHC Chief Justice Sardar Muhammad Sarfraz Dogar of misconduct. The allegations include pressuring him to resign amid a pending fake degree case.

Justice Tariq Jahangiri filed three petitions before the Federal Constitutional Court and the Islamabad High Court, challenging the proceedings of a division bench led by Chief Justice Dogar. He has also submitted a formal complaint to the Supreme Judicial Council (SJC).

The case concerns allegations of a fake law degree attributed to Justice Tariq Jahangiri. In his petitions, he contended that Chief Justice Dogarโ€™s conduct violated the Code of Conduct for Judges of the Supreme Court and High Courts. He argued that such violations barred the Chief Justice from hearing the case.

According to the petitions, Chief Justice Dogar allegedly discussed the sub judice matter with Justice Jahangiri and others. The Chief Justice reportedly acknowledged pressure to expedite the case. Justice Jahangiri claimed the Chief Justice suggested that submitting a post-dated resignation could satisfy those applying pressure and influence court proceedings.

Justice Tariq Jahangiri stated that such negotiations and contingent outcomes disqualify the Chief Justice from adjudicating the case. He described the conduct as an โ€œegregious violationโ€ of judicial code, which explicitly prohibits judges from discussing pending cases with involved parties.

Justice Jahangiri further alleged bias, citing his previous challenges to the Chief Justiceโ€™s transfer and appointment to the Islamabad High Court. He emphasized that prior restraining orders and recent decisions indicate apparent bias against him, making it inappropriate for Chief Justice Dogar to hear the petition.

The petitions by Justice Tariq Jahangiri seek the recusal of Chief Justice Dogar and highlight concerns about judicial impartiality and adherence to ethical codes within Pakistanโ€™s judiciary.

This development adds a new dimension to ongoing debates regarding judicial conduct and transparency in high-profile cases at the Islamabad High Court.
