ISLAMABAD: An Islamabad family court has dissolved the marriage of former senator Mushtaq Ahmed and Humaira Tayyaba through a khula decree.
The court issued the decision after attempts to reconcile the couple failed. Family Court Judge Amberin Iqbal approved the petition after considering Humaira Tayyaba’s statement during the proceedings.
According to the reported court order, Humaira Tayyaba appeared before the court and recorded her statement on oath. She made it clear that she no longer wished to continue her marriage with the former senator.
The judge reviewed her position and the outcome of the reconciliation process before granting the decree.
The case also involved financial matters and additional requests submitted by the petitioner. The court recorded that neither side had an outstanding claim against the other concerning haq mehr, commonly known as dower.
Humaira Tayyaba had also sought relief relating to child maintenance, expenses for unmarried daughters and other matters. However, she later withdrew these requests during the court proceedings.
The family court subsequently dismissed the withdrawn claims. This was a result of the petitioner’s decision to withdraw them, rather than a judgment on their merits.
The court also directed that certified copies of the khula decree be provided to Mushtaq Ahmed and the relevant Union Council.
The Union Council will complete the applicable legal formalities in line with the court’s decision. The reported order did not confirm when these procedures would be completed.
Under Pakistan’s family law framework, khula allows a Muslim woman to seek dissolution of her marriage through a family court. Reconciliation is generally attempted during the proceedings. If the efforts fail, the court may grant a decree in accordance with the applicable law.
The Islamabad court’s ruling follows Humaira Tayyaba’s statement that she did not wish to remain in the marriage. No further details about the personal reasons for the separation were provided in the reported court order.
