Sindh High Court (SHC) has directed the Karachi Development Authority (KDA) to pay Rs110 million in outstanding Pension and retirement dues to the legal heir of a deceased retired officer. The court ruled that pension and retirement benefits are legal rights and cannot be withheld due to financial difficulties.
The decision came after a constitutional petition filed by Sana Aziz, who sought payment of the retirement benefits owed to her late father, a former KDA officer. The court accepted the petition and ordered KDA to release the pending amount without further delay.
In its judgment, the Sindh High Court emphasized that Pension and retirement benefits are not optional payments. Instead, they are legally protected rights that every eligible retired employee or their lawful heirs are entitled to receive. The court stated that government institutions have a constitutional obligation to ensure timely payment of these benefits.
The bench also made it clear that financial constraints cannot be used as an excuse to delay or deny payments. According to the ruling, institutions must fulfill their legal responsibilities regardless of budgetary challenges.
During the proceedings, the petitioner’s lawyer informed the court that Aziz Ahmed, who served as Director IT at KDA, retired in 2012. Despite completing all legal formalities required after retirement, he did not receive his Pension or other retirement benefits during his lifetime.
After reviewing the available records, the court found that the outstanding retirement dues remained unpaid. Since the retired officer had passed away, the court ruled that his daughter, Sana Aziz, as his legal heir, has the lawful right to receive the pending payments.
The Sindh High Court subsequently directed KDA to pay Rs110 million in outstanding dues. It also instructed the authority to submit a compliance report to the Registrar of the Sindh High Court after making the payment.
Legal experts say the judgment reinforces the principle that retirement benefits are protected under the law. The ruling also highlights the responsibility of public institutions to honor their commitments to retired employees and their families.
The case has drawn attention because it addresses delays in the payment of retirement benefits, an issue that has affected many retired government employees. The court’s observations underline that such delays can place unnecessary financial hardship on pensioners and their families.
