A three-judge bench of the Supreme Court of Pakistan on Thursday granted bail to a man accused of rape in Toba Tek Singh.
The accused, identified as Mudassir, has consistently denied the allegations. His defence counsel told the court that he โvehemently refused to accept the allegation.โ
Justice Jamal Mandokhel stressed that allegations of serious crimes require thorough investigation. He noted that most such incidents remain unreported, and medical evidence in this case did not support the accusation against the man accused.
The governmentโs lawyer argued that the girl had stayed at the accusedโs home. However, the medical examination was conducted after a two-month delay, raising questions about the validity of evidence.
Justice Malik Shahzad observed, โIt is up to the plaintiff to prove the allegation, not the accused.โ Justice Musarrat Hilali added, โNo person will allege a daughter to make her a spectacle.โ
The judges noted that the girlโs statement alone is insufficient for conviction. Justice Mandokhel questioned whether consensual sex could ever justify a conviction under rape clauses, highlighting the need for careful legal consideration.
The case originates from an FIR registered by the girlโs father last year. The Supreme Courtโs decision to grant bail comes after reviewing all evidence, statements, and procedural details.
The bench emphasized that each allegation must be treated with seriousness, but proof is essential before convicting any individual. They also pointed out that delays in reporting or investigation can impact the credibility of claims.
Legal experts say that granting bail to a man accused does not dismiss the case, but ensures fair trial and protection of legal rights during the judicial process.
The courtโs ruling reflects the balance between safeguarding victims and upholding the principle that an accused is innocent until proven guilty.
