UN Warns Pakistan Amendments Threaten Rule of Law

The United Nations has expressed serious concern over Pakistan’s recent constitutional amendments, which grant lifetime immunity to top civil and military leaders. Critics argue the changes could weaken accountability, the Rule of Law, and fundamental human rights.

UN High Commissioner for Human Rights, Volker Türk, called the amendments “a severe threat to judicial independence” and warned that they could undermine the Rule of Law in Pakistan. He criticized the hasty manner in which the government passed the changes, saying authorities bypassed comprehensive consultation with legal experts and civil society.

Under the amendments, a new Federal Constitutional Court (FCC) now holds full authority over constitutional cases, a role previously reserved for the Supreme Court. Meanwhile, the Supreme Court’s jurisdiction has been restricted to civil and criminal matters.

The reforms also change the judicial appointment, promotion, and transfer system, raising fears that the judiciary may face increasing political influence. Türk highlighted that the first FCC Chief Justice and assisting judges were appointed by the President in consultation with the Prime Minister, raising questions about executive control over the judiciary.

“These changes increase the risk of political interference and compromise judicial independence,” Türk said. “Courts must remain independent to uphold the Rule of Law and protect human rights without external pressure.”

He stressed that judicial independence is vital for democracy, noting that when judges are not free from political influence, laws cannot operate equally, and human rights protection becomes difficult.

The amendments also grant lifetime immunity from criminal prosecution and arrest to the President, Field Marshal, Marshal of the Air Force, and Admiral of the Fleet. Türk cautioned that such sweeping immunity weakens accountability and could set a dangerous precedent.

The UN’s statement underscores growing international concern that Pakistan’s legal reforms may erode checks and balances, compromise judicial autonomy, and threaten the Rule of Law in the country.
