LONDON: Thousands of migrant workers in the UK could soon gain greater freedom to change employers. New immigration rules are expected to provide more flexibility for eligible workers.
The changes are scheduled to take effect on October 8, 2026. They could be especially important for migrant workers facing problems with their sponsors.
Workers may benefit when they face disputes over wages or working conditions. The changes could also offer more options for those dealing with unfair employment practices.
Under the new provisions, eligible Skilled Workers could take another job during the remaining period of their existing visa. However, they must continue following the conditions attached to their immigration status.
The changes could reduce workersโ dependence on a single sponsoring employer. This may make it easier for workers to leave unsuitable employment situations.
The UK government also has safeguards for workers facing serious sponsor-related concerns. These include issues involving passport retention and unlawful underpayment.
Workers can raise concerns about possible misconduct by their sponsors. The measures are intended to strengthen protections within the immigration and employment system.
UK Skilled Worker Visa
The Skilled Worker visa allows eligible foreign nationals to work for approved UK employers. The job must also fall within an occupation permitted under the immigration route.
However, securing a job offer alone does not guarantee visa approval. Applicants must meet several immigration requirements before receiving permission to work.
Job Offer and Sponsorship
Applicants normally need a confirmed job offer from an approved UK employer. The employer must hold a valid Skilled Worker sponsor licence.
The employer then provides a Certificate of Sponsorship (CoS). The applicant needs the CoS reference number for the visa application.
Eligible Occupation
The proposed job must be included in an eligible occupation. Applicants must also meet the conditions linked to the relevant occupation code.
The role must be genuine under UK immigration rules. Sponsorship cannot be used for sham jobs or roles created mainly to facilitate immigration.
Salary Requirements
Salary is another important condition for applicants. Workers generally need to meet the required minimum salary for their occupation.
They may also need to meet the applicable going rate. Salary rules can vary based on the job and individual circumstances.
Different requirements may apply to certain healthcare and education positions. Special rules can also cover Immigration Salary List jobs and transitional arrangements.
English Language Requirement
Applicants generally need to demonstrate English proficiency at B2 level under the CEFR system. This applies to reading, writing, speaking, and listening.
Some applicants can meet the requirement through a qualifying degree taught in English. Others may need to complete an approved English-language test.
Certain people extending older Skilled Worker permission may face the previous B1 requirement.
Required Documents
Applicants generally need several documents during the application process. These can include a Certificate of Sponsorship reference number and valid passport.
They may also need proof of English proficiency and employment details. Job title, annual salary, occupation code, and sponsor information can be required.
Additional evidence may apply depending on individual circumstances. This can include proof of funds, tuberculosis test results, or criminal-record certificates.
Some applicants may also need an ATAS certificate.
For existing Skilled Workers, the upcoming changes could provide greater employment mobility. Workers may have more options if their current employment becomes unsuitable.
The reforms do not provide unlimited permission to work in any position. Workers must continue meeting the conditions attached to their immigration status.
The new provisions are expected to take effect on October 8, 2026. Skilled Workers and prospective applicants will be watching the changes closely.

The reforms could influence employment mobility and sponsor responsibilities across the UK. They may also give migrant workers greater confidence when dealing with difficult workplace situations.
