ISLAMABAD: The Govt has officially notified the proclamation of emergency in Khyber Pakhtunkhwa (KP) under the Constitution of Pakistan.
President Asif Ali Zardari has proclaimed the emergency under Articles 232 and 234 of the Constitution. The presidential proclamation came into effect immediately, according to the official notification.
The notification was published in the government gazette. It cites the rising number of terrorist attacks and violent incidents across the province as major reasons for the decision.
According to the notification, the security situation in KP has become increasingly concerning. Terrorist attacks have threatened the lives and property of residents across the province.
The document also highlights an increase in attacks against government installations and law enforcement agencies. These incidents have raised serious concerns about public safety and the province’s overall security.
The notification states that the provincial government has failed to control terrorism effectively. It also refers to the governor’s report, which reportedly identified failures within the constitutional system.
According to the proclamation, the situation in Khyber Pakhtunkhwa has moved beyond the provincial government’s control. The notification describes the security situation as a threat to Pakistan’s overall national security.
The emergency proclamation outlines several powers available to the federal government during this period. Under the notification, the federal government may direct the KP governor to exercise certain provincial government powers.
The governor may perform responsibilities delegated by the federal government under the emergency arrangements. These measures could affect the province’s administrative and legislative structure.
The notification also allows Parliament or an authority designated by it to exercise certain legislative powers. These powers would otherwise fall under the provincial assembly’s jurisdiction.
Furthermore, the federal government may assume specific provincial functions during the emergency. The measures aim to address the situation described in the presidential proclamation.
The notification also outlines significant changes involving the provincial administration. According to the document, the chief minister, provincial ministers, advisers, special assistants, and advocate general will no longer remain in their offices.
The decision marks a major development in the province’s political and administrative affairs. It follows concerns about the worsening security situation and the provincial government’s ability to respond to terrorism.
The Govt’s move comes amid continued security challenges in Khyber Pakhtunkhwa. The province has experienced repeated attacks targeting security personnel and government facilities.
The emergency proclamation provides the legal framework for the federal government to exercise specified powers. Its implementation will determine how provincial administrative and legislative responsibilities are handled during the emergency.
