Assam government has announced action against government employees who marry again without legally ending their first marriage.
Chief Minister Himanta Biswa Sarma said the measure would provide financial protection to the first wife.
Under the announced policy, an employee entering a second Marriage could face a 20% deduction from their salary. The rule would apply when the employee’s first marriage remains legally valid.
According to the announcement, the deducted amount would be transferred directly to the first wife. She would first need to approach the relevant authorities and apply for financial support.
The salary deduction could also continue if the employee has already filed a divorce case in court. The government says filing for divorce does not immediately end the existing Marriage under the law.
Therefore, financial support for the first wife could continue while the legal proceedings remain pending. The measure is intended to provide financial protection until the divorce process reaches its legal conclusion.
The latest announcement comes as the Assam government continues tightening its approach towards polygamy. Earlier, the state government proposed changes concerning government employees involved in polygamous marriages.
Under those proposals, public employees practising polygamy could potentially face dismissal from government service. The government has also considered restrictions on access to certain welfare benefits under its broader measures.
However, the implementation of such measures would depend on applicable laws, rules and administrative procedures. The state government has also announced measures concerning employees who fail to support their parents financially.
Under the reported plan, authorities could deduct 10% from an employee’s salary for parental financial support. The deducted amount would be used to assist parents who depend financially on the government employee.
These measures are aimed at ensuring that public servants fulfil their financial responsibilities towards dependent family members. The proposed 20% salary deduction related to a second Marriage is specifically intended to protect the first wife financially.
It could remain applicable while divorce proceedings continue, depending on the circumstances and relevant administrative requirements.
The Assam government says its broader approach focuses on strengthening family responsibilities among public employees.
The measures cover financial responsibilities towards spouses as well as dependent parents. Government employees affected by the rules would need to follow the applicable legal and administrative procedures.
