First Wife Cannot End Marriage Over Husband’s Second Marriage: Islamic Council

The Council of Islamic Ideology (CII) has ruled that allowing a first wife to annul her marriage if her husband remarries without her consent contradicts Islamic principles.

Announcing its decision after a meeting on Wednesday, the CII rejected the legal provision permitting women to dissolve their marriage on these grounds, according to Express News. The council asserted that Islamic teachings do not support such a right, reaffirming its stance on polygamous unions based on traditional interpretations.

Additionally, the council deliberated on incorporating medical tests for thalassemia and other infectious diseases in marriage contracts. It concluded that while these tests could be included as an optional requirement, they should not be mandated as a religious obligation for marriage. This decision aims to balance public health concerns with personal freedoms under Islamic law.

During the meeting, the CII also addressed linguistic and ethical matters, stating that key Islamic terms such as Salah (prayer), Ayah (verse), and Masjid (mosque) should not be translated into English. The council emphasized that maintaining the original Arabic words preserves their religious significance and prevents misinterpretation.

Furthermore, religious scholars and community leaders were urged to actively discourage electricity theft, which the council classified as both an economic offense and an ethical violation.

The CII also reviewed the government’s contributory pension scheme, endorsing its implementation for newly hired employees while stressing that current employees should not be compelled to join the system. The council insisted that the scheme must be free from interest-based (riba) financial elements to ensure compliance with Islamic financial principles.

Lastly, a discussion on the establishment of human milk banks was deferred, with the council stating that further religious and ethical consultations were necessary before reaching a decision.

As an advisory body, the CII provides guidance on aligning national laws with Islamic teachings, influencing legal and religious discussions in Pakistan despite lacking legislative authority.
