US Officials Oppose ICC Warrants for Netanyahu, Gallant, Threaten Sanctions

The United States has strongly opposed the International Criminal Court’s (ICC) decision to issue arrest warrants for Israeli Prime Minister Benjamin Netanyahu, former Defense Minister Yoav Gallant, and Hamas commander Mohammed Deif, over alleged war crimes. The ICC claims “reasonable grounds” exist to hold the men criminally responsible for offenses including murder, persecution, and starvation as methods of warfare, particularly in Gaza and the West Bank.

While Israel insists that Deif was killed in an airstrike, the ICC prosecutor’s office has not verified this, continuing its investigation into him for charges of murder, torture, and sexual violence. In response to the warrants, Netanyahu condemned the ICC, calling it “antisemitic” and accusing the court of undermining Israel’s right to self-defense. His government, supported by Republican figures in the US, has called for sanctions against the Hague-based tribunal.

The Biden administration reiterated its opposition to the ICC’s jurisdiction, as Israel is not a signatory of the court. US officials argue that the ICC has no authority over Israeli officials, especially in territories like Gaza and the West Bank. In contrast, some European nations, including Italy and the Netherlands, have expressed willingness to enforce the warrants should the individuals travel through their territories.

The ICC’s actions have sparked a global debate, with Palestinians and some international lawmakers celebrating the warrants as a step toward justice, while others, particularly in the US and Israel, view it as an overreach of authority. The tensions reflect the broader geopolitical divides over the Israeli-Palestinian conflict and the role of international justice bodies.
